Welcome to the https://bowisengineering.com/ website and related cloud-based services (the “Site”) owned by Bowis Engineering LLC (“Owner,” “we,” or “us”). Owner is committed to maintaining the privacy and security of your personal information. “Personal Information” means information that identifies you personally, such as your name, physical address, email address, phone number, or credit card information. As part of our commitment to the privacy and security of your Personal information, Owner has developed this Privacy Policy to make you aware of our information gathering practices and how we use the information we receive.
By using the Site, you signify your agreement to the terms of this privacy policy (the "Privacy Policy"). If you do not agree to this Privacy Policy, please do not use this Site. Owner reserves the right, in its sole discretion, to modify, alter or otherwise update this Privacy Policy at any time. You will be notified of changes to the Privacy Policy via a notation next to the link to the Privacy Policy from the main page of the Site stating that the Privacy Policy is new and the date on which it was updated; if you have an account, you will also receive an email from Owner before any changes to the Privacy Policy. The last date on which the Privacy Policy was updated appears at the bottom of this page. By continuing to use this Site after changes to the Privacy Policy are posted, you agree to these modifications, alterations and/or updates.
Please also review the Terms of Use (“TOU”) of this Site and the End User License Agreement (“EULA”). Together, these documents are the terms of an agreement between you and Owner (the “Terms”) regarding your use of the Site and the Bowis Engineering CAN-Parse application (the “App”). By accessing, browsing, or using the Site, or by downloading the App, you acknowledge that you have read, understood, and agree to be bound by the Terms and to comply with all applicable laws and regulations, including export and re-export control laws and regulations. If you do not agree to the Terms, please do not use the Site or the App (together, the “Services”).
DATA WE GATHER FROM YOU
You can visit and browse this Site or download the App without telling us who you are or revealing any Personal Information. If you choose only to look at the Site or download the App and do not wish to obtain product-specific information or purchase a license to activate the App, you need not provide any Personal Information.
If you want to purchase a license to activate the App, you will need to create an account. When you create an account with us, we will ask you for the following Personal Information: email address and business name. This information may be used for various marketing and/or business purposes including, but not limited to, providing access to the App, customizing your experience with the Services, resolving disputes, troubleshooting problems, enforcing our agreements with you, or direct email from Owner. We will share your Personal Information within our corporate family and with our third-party vendors as necessary for these purposes.
In addition, our payment processing vendor, Stripe, will collect additional information from you for the purpose of validating and authorizing your payment. This information includes information regarding your credit card account, such as name, card number, and other information needed to process the transaction. This credit card information is used for verification of a valid credit card and authorization for the value of the requested purchase. Our license key generation vendor, KeyGen, will receive your email address and company name along with confirmation that you have paid for your license from Stripe. It will then generate your license key and send it to you and Owner by email. Communication between Stripe and KeyGen is facilitated by Zapier.
AUTOMATIC DATA COLLECTION
Many websites collect data from your device; the Site and the App do not do so.
COOKIES AND WEB BEACONS; DO NOT TRACK
The Site and the App do not use cookies or web beacons.
Many other websites do use cookies or web beacons. Most browsers are set to accept cookies, but you can change your browser setting to block cookies. Although disabling cookies will not interfere with your ability to access the Site, you will need to accept cookies to use certain services on the Site, including logging into your account to make purchases. You can also disable the ability of web beacons to capture information by blocking cookies.

DISCLOSURE OF INFORMATION WE COLLECT
Owner will disclose Personal Information 1) in accordance with this Privacy Policy; 2) in order to comply in the event that law requires a disclosure of information submitted to our Site, including when required by a warrant, subpoena or court order; or 3) when we believe in good faith that disclosure is necessary to prevent harm or injury, such as in the event of product recalls, fraud, claims or other liability. Owner does not sell, trade, or rent your personal information to outside parties. Owner may share statistical information about our users, traffic patterns, and related Site information, in aggregate form, with third-party affiliates and vendors, but these statistics will include no Personal Information.
YOUR CHOICES REGARDING YOUR PERSONAL INFORMATION
If you do not wish to receive promotional material from us, you may select the appropriate “opt out” option each time we ask for your Personal Information. If you already receive email communications from us and no longer wish to receive such communications, please contact us at support@bowisengineering.comto be removed from our email list.

We do not endorse and are not responsible for the information practices or privacy policies of websites operated by others that may be linked to or from the Services. If you decide to access a third party’s website that may be linked to or from the Services, you should consult that website’s privacy policy.
BUSINESS TRANSITION
The information covered by this Privacy Policy is an asset of Owner and will become part of our normal business records. If Owner or a substantial part of our business is sold or otherwise transferred to a third party, such as a legal successor in interest, your information may be transferred to that third party.
UPDATING OR DELETING YOUR INFORMATION; RECEIVING A COPY OF YOUR INFORMATION
If any of the Personal Information you submitted to our Site is inaccurate or outdated or otherwise needs to be changed or deleted, please contact us at support@bowisengineering.comand we will use reasonable efforts in our control to revise or delete that information. If you would like a copy of the information we have on file for you, please contact us at support@bowisengineering.comand we will provide you a copy of your information; however, if you want to know what payment information was used to purchase a license key, please contact Stripe. We do not have access to your information stored with Stripe.
For deleting your Personal Information, you may also use the “delete” link in the email where you received your license key for the App; however, do not use the “delete” link unless you are certain that you no longer wish to use the App. Deletion removes Owner’s record of your license and cannot be undone.
Owner reserves the right to take steps to verify your identity prior to providing you a copy of your information or altering or deleting your Personal Information. If you believe Owner erroneously determined that you are not authorized to receive a copy of, alter, or delete your Personal Information, you may contact support@bowisengineering.comto appeal such determination by providing supporting documentation of your identity. Owner will respond to requests within 15 days of receipt.
HOW WE SECURE YOUR INFORMATION
The Services have industry-standard measures in place to protect the loss, misuse and alteration of the information under our control, including encryption and two-factor authentication. Personal Information that you submit to the Site is stored on encrypted drives and by Stripe, KeyGen, Zapier, and Microsoft. Owner updates its policies and procedures and refreshes its physical and technological safeguards for Personal Information at least once per year. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Information, you acknowledge that: 1) there are privacy and security risks to the Internet which are beyond our control; 2) the security, integrity and privacy of any and all information exchanged between you and us through the Site cannot be guaranteed; and 3) any information or data may be viewed or tampered with by a third party while in transit.
Be aware that these measures standing alone are not sufficient to ensure the security of your Personal Information. It is also important for you to guard against unauthorized access to your passwords and unauthorized use of your computers and mobile devices.
CHILDREN
Protecting the privacy of children is very important to us. For that reason, our Site does not intentionally solicit, collect and/or maintain personally identifiable information from users under age 18. If you are under the age of 18, we ask that you do not submit any Personal Information to us and use this Site only under the supervision of a parent or guardian. If you are a parent or guardian and you believe your child has submitted Personal Information to us, please contact us at support@bowisengineering.com, and we will delete your child’s Personal Information from our records.
DISPUTES
You agree that any claim or controversy arising out of or relating to the Services, or to any acts or omissions for which you may contend Owner is liable, including but not limited to any claim or controversy as to arbitrability ("Dispute"), shall be finally and exclusively settled by arbitration. The arbitration shall be venued in Minneapolis, Minnesota, and shall apply the laws of the State of Minnesota, excluding its conflicts of laws provisions. Arbitration will be conducted under the rules of the American Arbitration Association ("AAA"). The parties will jointly agree upon a neutral arbitrator. Any judgment upon the award rendered by the arbitrators may be entered in any court of competent jurisdiction. The agreement to arbitrate shall not be construed as an agreement to the joinder or consolidation of arbitration under this agreement with arbitration of disputes or claims of any non-party, regardless of the nature of the issues or disputes involved. To the fullest extent permitted by applicable law, no arbitration under these Terms shall be joined to an arbitration involving any other party subject to these Terms, whether through class arbitration proceedings or otherwise.
THIS AGREEMENT PROVIDES THAT ALL DISPUTES BETWEEN YOU AND OWNER WILL BE RESOLVED BY BINDING ARBITRATION. YOU THUS GIVE UP YOUR RIGHT TO GO TO COURT TO ASSERT OR DEFEND YOUR RIGHTS. YOU ALSO GIVE UP YOUR RIGHT TO PARTICIPATE IN OR BRING CLASS ACTIONS. YOUR RIGHTS WILL BE DETERMINED BY NEUTRAL ARBITRATORS AND NOT A JUDGE OR JURY. You are entitled to a fair hearing, and the arbitration procedures are simpler and more limited than rules applicable in court. Arbitrator decisions are enforceable as any court order and are subject to very limited review by a court. By using the Services and by purchasing a license under the Terms, you consent to these restrictions.
Should a Dispute arise and should the arbitration provisions herein become inapplicable or unenforceable, or in any instance of any lawsuit between you and Owner, you agree that jurisdiction over and venue of any suit shall be exclusively in the state and federal courts sitting in Hennepin County, Minnesota. If either party employs attorneys to enforce any right in connection with any Dispute or lawsuit, the prevailing party shall be entitled to recover reasonable attorneys' fees.
If any part of this agreement is invalid or unenforceable under applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall govern such use.
